JD Lakshminarayana provided clarification on the legal procedures surrounding the arrest of Kavitha, citing pertinent sections of the CrPC. According to Lakshminarayana, under section 161 of the CrPC, women are not obligated to visit inquiry offices; instead, inquiry officers are required to conduct inquiries at their location.<\/p>\n\n\n\n

Highlighting the summoning of Kavitha by the Enforcement Directorate (ED) to Delhi and the distinction between inquiries under the PMLA Act and CrPC, Lakshminarayana referred to the pending Supreme Court decision, which has postponed the case to the 19th of the month.<\/p>\n\n\n\n

Lakshminarayana elaborated on the process of presenting an arrested individual before a magistrate, emphasizing the rights of the arrested individual, as established in the Anvesh Kumar case verdict.<\/p>\n\n\n\n

Responding to comments by KTR regarding the transfer of Kavitha without a transit warrant, Lakshminarayana explained the standard procedures under the CrPC and the necessity of presenting the arrested individual before a magistrate within 24 hours.<\/p>\n\n\n\n

Addressing allegations of political motives behind Kavitha’s arrest, Lakshminarayana suggested that if Kavitha perceives political reasons for her arrest, these could be brought before the magistrate. He acknowledged that while there are no specific rules against arrests during elections, such actions during this time would inevitably lead to public debate.<\/p>\n\n\n\n
